Postfox is run by Benoît Rossignol, entrepreneur individuel (sole trader) registered in France, trading as BR Media, SIREN 789 477 726, 123 Avenue Henri Ginoux, 92120 Montrouge, France (“Postfox”, “we”). Contact: hello@postfox.ai.
Postfox writes LinkedIn posts for a company’s employees, in each employee’s own words and voice. Every post is approved by the person whose name goes on it before anything is published.
Part A applies to everyone who uses Postfox (the “Terms of Use”). Part B applies to the company that subscribes (the “Customer Agreement”). The privacy policy explains what we do with personal data.
Part A: Terms of use, for everyone who uses Postfox
A.1 Your account
You join Postfox when a company that uses it invites you (a “Member”), or when you set Postfox up for your company (an “admin”). Give accurate information, keep your sign-in to yourself, and tell us at hello@postfox.ai if you think someone else has used your account. One account is for one person.
A.2 Connecting LinkedIn
When you connect LinkedIn, you authorise Postfox to publish, under your name, the posts you approve, at the time you choose, and nothing else. Postfox does not read your LinkedIn: not your messages, connections, feed or anyone else’s posts. You can disconnect LinkedIn at any time from your settings, which stops all publishing for you at once. What you publish on LinkedIn is also subject to LinkedIn’s own terms.
A.3 Your approval is the decision
Postfox drafts posts with a language model. A draft can be wrong, and before you approve it Postfox shows any detail it could not trace to something you or your company supplied. Nothing is published unless you approve it, and no one else can approve, change or publish a post for you. Read what you approve: a post published under your name is yours, as if you had written it.
A.4 What is yours
What you give Postfox (what you tell it about your work, the posts you paste, your settings and rules, your captures) and the posts you write for yourself stay yours. You let Postfox use them only to provide the service to you and, for the posts of your company’s campaigns, to your company, as the privacy policy describes. Your company’s admins see a post written for you in their campaigns once you approve it. They do not see the posts you write for yourself, or what you told Postfox about your work.
A.5 What you may not do
Do not use Postfox to publish anything unlawful, defamatory, misleading, discriminatory or infringing someone else’s rights; to impersonate anyone or publish for someone other than yourself; or to break LinkedIn’s terms. Do not try to reach data that is not yours, test the security of the service without our written permission, overload it, copy it, or access it by automated means other than the service itself.
A.6 Leaving
You can delete your account at any time from your settings. Deleting it removes your profile, your writing profile, what you told us about your work, your times, your posts and the records of the checks run on them, as the privacy policy describes. Posts already published on LinkedIn stay on your LinkedIn account. If your company stops using Postfox or removes you, your own account and the posts you wrote for yourself stay yours to read, export or delete, until you delete your account. Writing, generating or booking posts with Postfox again means joining a company that uses it.
A.7 If we have to act
We may suspend an account that breaks these terms or puts the service or other people at risk, and we tell the person why unless the law or a risk to others prevents it.
A.8 The rest
The service is provided as it is, within the limits of Part B for the company that subscribes. French law governs these terms. If you use Postfox as a consumer, you keep the rights the law of your country gives you.
A.9 Fair use
Regenerate or rework any post with AI as often as you need. Fair-use limits apply: to prevent abuse and keep the service working for everyone, AI actions (writing a post again, or rewriting it with your own instruction or a one-click tool) have an hourly, a daily and a monthly limit for each person, and a daily limit for each company. When you reach one, Postfox tells you when you can use AI again. Editing a post yourself is never limited, and nothing you have written is lost.
Part B: Customer agreement, for the company that subscribes
B.1 The agreement
The Customer Agreement is made of: the plan the Customer subscribes to in Postfox, or an order or quote it accepts (the “Order”), which states the service, the number of Members and the price; this Part B; Part A, which the Customer’s admins and Members accept; and the data processing agreement, which Postfox provides with the Order, or on request at hello@postfox.ai. If they conflict, the Order prevails, then the data processing agreement on data protection, then these terms.
B.2 The service
Postfox lets the Customer’s admins describe the company, run campaigns from a brief, and invite Members. For each campaign, Postfox writes a draft for each Member included, in that Member’s voice, checks it against the material it was written from, and asks the Member to approve it; an approved post is published on the Member’s LinkedIn account at the time the Member chose. Members can also write posts for themselves. The security document the Customer receives describes how the service works and what it does not do.
B.3 Taking part is voluntary
Employee advocacy works only if people take part because they want to. The Customer does not require any Member to join, to approve a post, or to publish, and does not treat a Member differently because they declined a post. Postfox is built so that a Member can always decline, and so that nothing is published without their approval. Postfox does not tell the Customer which Member declined a post.
B.4 What the Customer is responsible for
The Customer:
- gives Postfox accurate information about itself and its campaigns, and has the right to share the documents it uploads;
- runs campaigns that are lawful, including the rules that apply to employees speaking about their employer (for example, disclosing that relationship where the rules of the country require it);
- invites only people who work for it or have agreed to take part, and chooses its admins carefully;
- does not put special categories of personal data, or data about criminal convictions, in its briefs or documents.
B.5 Data
The data processing agreement governs the personal data Postfox processes for the Customer’s campaigns, as the Customer’s processor. Postfox is controller of account, billing and security data and of the posts a Member writes for themselves, as the privacy policy describes. The Customer keeps all rights in what it gives Postfox, and lets Postfox use it only to provide the service. Postfox does not use it to train language models, and the provider of the models Postfox uses does not either.
B.6 Price and payment
- Price. In US dollars, with unlimited campaigns, each for up to 200 people with up to 2 posts per person. Regenerate or rework any post with AI as often as you need. Fair-use limits apply (A.9). The plans:
- Monthly: $190 a month, 10 Members included, then $19 per extra Member.
- Yearly: $1,800 a year, 10 Members included, 2 months free, then $180 per extra Member a year.
- Who is billed. A Member counts from the day they accept their invitation and create their account; someone who never accepts is never billed. The price of each period includes 10 Members who count, and each Member who counts beyond 10 is an extra Member. An extra Member who joins during a period is billed from the day they accept, pro rata, on the next invoice; when the number of extra Members goes down during a period, the difference is credited pro rata on the next invoice.
- Payment. The Customer pays by card through Stripe, our payment provider. The subscription is charged automatically at the start of each period, monthly or yearly as the Order says, in US dollars, and Stripe issues the invoice and the receipt. A Customer who needs to pay against an invoice instead can ask us: where Stripe offers it for that Customer, we send invoices payable within 30 days of their date.
- Taxes. Prices exclude taxes. Any VAT or similar tax that applies is added to the invoice, or accounted for by the Customer where the reverse-charge rules apply.
- Late payment. An amount not paid when due, a card charge that fails and is not put right or an invoice past its date, bears interest from the day after it was due at three times the French legal interest rate, and a fixed indemnity of €40 for recovery costs (Code de commerce, articles L441-10 and D441-5), without a reminder being needed. If it is still unpaid 15 days after we told the Customer in writing, we may suspend the service until it is paid.
- Price changes apply from the next renewal, with at least 30 days’ notice.
B.7 The free campaign
The Customer’s first campaign is free, for up to 10 Members, with no time limit. It is used when an admin launches it (“Launch campaign”). While it runs, no Member is billed, even one who has accepted their invitation; billing starts when the Customer moves to a paid plan. It is provided as it is.
B.8 How long, and ending it
- The Customer Agreement runs month to month or year to year, as the Order says, and renews automatically for the same period.
- The Customer may cancel at any time. Cancellation takes effect at the end of the current period, and the period already started is not refunded. Postfox may end the agreement at the end of a period with 30 days’ notice.
- Either party may end it by written notice if the other breaks it seriously and has not put it right within 30 days of being told.
- When it ends, Members’ access to the Customer’s organisation ends. For 30 days the Customer can ask for a copy of its data; Postfox then deletes the organisation, as the data processing agreement sets out. Fees already due stay due; fees paid in advance are refunded only where these terms say so.
B.9 Availability and support
Postfox is early and run by one person. We work to keep the service available and to fix failures quickly, but we do not promise a level of availability or a time to repair a failure, and there is no 24/7 on-call rota. Support is by email at hello@postfox.ai, answered within two working days. The service depends on LinkedIn and on the providers listed in the data processing agreement; when LinkedIn changes or withdraws access, or a Member’s authorisation expires, publishing may stop until it is restored. We tell the Customer in advance of planned work that interrupts the service.
B.10 Intellectual property
Postfox and everything in it, apart from the Customer’s and Members’ content, belong to Postfox. The Customer may use it for its own business while the Customer Agreement lasts. Suggestions the Customer makes about Postfox may be used freely. Postfox may name the Customer as a customer, with its name and logo, unless the Customer objects in writing.
B.11 Confidentiality
Each party keeps confidential what the other shares that is not public, uses it only for the Customer Agreement, and shares it only with those who need it and are bound likewise, during the agreement and for three years after.
B.12 What Postfox promises, and what it does not
Postfox provides the service with reasonable skill and care, as described in B.2 and the security document. Drafts written by a language model can contain errors; that is why every post waits for its Member’s approval, and Postfox does not promise any result on LinkedIn: reach, engagement or business outcomes. Beyond this clause, and as far as the law allows, the service is provided as it is.
B.13 Liability
- Neither party is liable to the other for indirect losses, including lost profit, revenue, business or goodwill.
- Each party’s total liability under the Customer Agreement is limited to the fees the Customer paid in the 12 months before the claim, or $1,000 if that is more.
- These limits do not apply to fraud, gross negligence (faute lourde) or wilful misconduct, to the Customer’s obligation to pay, or to any liability the law does not allow to be limited.
B.14 Claims about content
The Customer defends Postfox against claims by third parties arising from the material the Customer supplied or the campaigns it ran, and pays the damages awarded, provided Postfox tells it promptly and lets it conduct the defence.
B.15 Changes
Postfox may improve the service. A change that materially reduces it, or a change to these terms, is announced to the Customer at least 30 days before it takes effect; if the Customer objects, it may end the Customer Agreement before then, and Postfox refunds the fees paid in advance for the time after it ends.
B.16 General
- Neither party is liable for a failure caused by events beyond its reasonable control.
- Neither party may transfer the Customer Agreement without the other’s written consent, except Postfox to a business that takes over the service, with notice to the Customer.
- Notices are sent by email: to hello@postfox.ai, and to the address of the Customer’s admin given in the Order.
- If a clause is invalid, the rest stands. Not acting on a right is not giving it up. The Customer Agreement is the whole agreement on its subject.
- The English text governs. A translation, if one is provided, is for convenience only.
- French law governs the Customer Agreement. The parties first try to settle a dispute amicably.
